OVERVIEW
Welcome to Crazy $20 Store. The terms “we”, “us” and “our” refer to Crazy $20 Store. We operate crazy20.store and the related products, content and services (the “Services”). Our store is hosted by Shopify.
These Terms of Service govern your use of the Services and any purchase from us. By visiting the site, creating an account or placing an order, you agree to these Terms, our Privacy Policy, Return and Refund Policy and Shipping Policy. If you do not agree, do not use the Services.
1. ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority where you live, or use the Services with the consent and supervision of a parent or legal guardian. Information you provide must be accurate, current and complete. You are responsible for safeguarding your account credentials and for activity under your account.
2. PRODUCTS AND AVAILABILITY
We try to present product descriptions, specifications, colours, images and availability accurately. Screens and lighting can affect how colours appear. Packaging, minor design details and fulfilment location may change without materially changing the product.
Products are subject to availability. We may limit quantities, discontinue a product or refuse an order where reasonably necessary, including for suspected fraud, pricing errors, stock shortages, resale activity or legal restrictions. If we cancel an order after payment, we will refund the affected amount.
3. PRICES, CURRENCY AND PAYMENT
Prices are displayed in the currency shown on the site and may change without notice. The price that applies is the price shown at checkout when the order is placed, subject to correction of an obvious error. Shipping charges, taxes, duties and other charges are shown at checkout where we collect them or otherwise described in our policies.
You confirm that you are authorised to use the payment method submitted and that the billing information is correct. Payment processing is provided by Shopify and other payment providers under their own terms and privacy practices.
4. ORDERS
Submitting an order is an offer to purchase. An order-confirmation email acknowledges receipt but does not by itself guarantee acceptance or shipment. We accept the order when we begin fulfilment or send shipping confirmation.
Review your order carefully before submitting it. Cancellation and address-change requests should be made within 12 hours and are handled according to our Return and Refund Policy and Shipping Policy.
5. SHIPPING AND DELIVERY
Our processing times, delivery estimates, tracking procedures, third-party fulfilment disclosure and rules for delays or lost parcels are set out in the Shipping Policy at crazy20.store/policies/shipping-policy. Delivery dates are estimates unless we expressly state otherwise. Nothing in these Terms removes a remedy that applicable consumer law provides for late or failed delivery.
6. RETURNS, REFUNDS AND CANCELLATIONS
Our 30-day return conditions, refund timing, damaged-item procedure, exclusions, exchanges and cancellation rules are set out in the Return and Refund Policy at crazy20.store/policies/refund-policy. Nothing in that policy or these Terms limits mandatory consumer rights.
7. ACCEPTABLE USE
You may use the Services only for lawful personal or household purposes. You must not:
• violate any law or another person's rights;
• submit false, misleading, fraudulent or harmful information;
• introduce malware, scrape the site unlawfully, bypass security or interfere with the Services;
• impersonate another person;
• use our content, brand or Services for unauthorised commercial resale;
• harass, abuse, threaten or discriminate against another person.
We may suspend or terminate access for conduct that violates these Terms or creates a security, legal or operational risk.
8. INTELLECTUAL PROPERTY
The site design, branding, text, graphics, videos, logos and other content are owned by or licensed to Crazy $20 Store, Shopify or their respective rights holders. You may access the Services for personal, non-commercial use. You may not copy, reproduce, distribute, modify, sell, exploit or create derivative works from protected content without written permission, except where law permits.
9. REVIEWS AND FEEDBACK
If you submit a review, photo, suggestion or other content, you confirm that you have the right to submit it and that it is truthful, lawful and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display that content to operate and promote the Services. We may remove unlawful, abusive, misleading or irrelevant content.
10. THIRD-PARTY SERVICES AND LINKS
The Services may include third-party apps, payment tools, fulfilment services and links. Their services may be governed by separate terms and privacy policies. We are not responsible for an independent third party's website or content, but this does not limit our responsibility for obligations that the law places on us as the seller.
11. SHOPIFY
Shopify provides the commerce platform that enables our store. Purchases are made from Crazy $20 Store, not Shopify. Shopify is not the seller of our products and is not responsible for fulfilling our customer orders.
12. PRIVACY
Our collection and use of personal information is described in our Privacy Policy at crazy20.store/policies/privacy-policy. Shopify and other service providers may process personal information to provide the Services, payments, fraud prevention, analytics and fulfilment.
13. DISCLAIMERS
We aim to keep the Services accurate, secure and available, but cannot promise uninterrupted or error-free access. To the maximum extent permitted by law, the Services are provided on an “as available” basis. Product warranties and remedies are those stated in our policies or required by law.
Nothing in these Terms excludes any guarantee, warranty, duty, right or remedy that cannot lawfully be excluded.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Crazy $20 Store will not be liable for indirect, incidental, special or consequential loss arising from use of the Services. Where liability cannot be excluded but may be limited, our total liability will not exceed the amount paid for the product or order giving rise to the claim.
These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not allow us to exclude or limit.
15. INDEMNITY
To the extent permitted by law, you agree to compensate Crazy $20 Store for reasonable losses and costs caused by your unlawful use of the Services, your material breach of these Terms or your infringement of another person's rights. This section does not apply where the loss was caused by our own breach, negligence or unlawful conduct.
16. CHANGES TO THE SERVICES OR TERMS
We may update the Services and these Terms from time to time. The current version will be posted on this page with its updated date. Material changes apply prospectively after publication unless law requires otherwise. Your continued use after an update means you accept the revised Terms.
17. SEVERABILITY AND WAIVER
If any provision is held unlawful or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue. A delay in enforcing a right is not a waiver of that right.
18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. Courts with jurisdiction in the Western Cape may hear disputes. If mandatory consumer law in your place of residence gives you additional rights or allows you to bring a claim locally, those rights are not affected.
Before starting formal proceedings, please contact us so we can try to resolve the matter fairly and promptly.
19. ENTIRE AGREEMENT
These Terms and the policies referenced in them form the entire agreement between you and Crazy $20 Store regarding the Services and replace prior communications on the same subject.
